These Terms of Service ("Terms") govern your access to and use of Pineapple Storytime, a service provided by Pineapple Storytime LLC, a New Mexico limited liability company with principal offices at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110 ("Pineapple Storytime," "we," "our," or "us"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Pineapple Storytime ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all the terms and conditions, you may not access or use the Service.

2. Description of Service

Pineapple Storytime is an interactive digital reading platform providing access to a curated library of original children's stories written by A.R. Yeager. The Service is available through individual, care provider, and company subscription plans. Features include digital books, reading activities, announcements, calendars, and messaging tools for organizational accounts.

3. Eligibility & Accounts

You must be at least 18 years old to create an account. By creating an account you represent that you are of legal age and capable of entering into a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@pineapplestorytime.com of any unauthorized use.

4. Children & COPPA

Pineapple Storytime does not collect personal information from children. The Service is designed so that children may view and read stories without the Service capturing any identifying information about them. Children do not create their own accounts. Any child who accesses the Service does so through an adult account (a parent, guardian, teacher, or authorized care provider) who is solely responsible for supervising use.

We comply with the Children's Online Privacy Protection Act (COPPA) and design the Service to minimize data collection. See our Privacy Policy for full details.

5. Subscription Plans & Billing

The Service offers multiple subscription tiers (Individual, Care Provider, and Company). Pricing is shown at checkout and on our Plans page. Subscriptions are billed monthly or annually in advance and automatically renew at the end of each billing period unless you cancel.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not provide pro-rated refunds for partial periods, except where required by law.

Price changes: We may change subscription prices from time to time. We will provide at least 30 days' notice before any price increase applies to your account.

Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms.

6. Intellectual Property

All content on the Service — including stories, illustrations, text, graphics, logos, audio, trademarks, and software — is the property of Pineapple Storytime LLC or its licensors (including A.R. Yeager) and is protected by United States and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal or internal organizational use only. You may not reproduce, distribute, publicly display, modify, or create derivative works from any content, or remove proprietary notices, without our prior written permission.

7. Acceptable Use

You agree not to:

share account credentials with anyone outside your household or organization;
attempt to access another user's account or data;
use automated scrapers, bots, or other tools to extract content;
copy, mirror, broadcast, or redistribute our stories or illustrations;
reverse-engineer, decompile, or disassemble the Service;
use the Service to harass, harm, or discriminate against others;
upload malicious code or interfere with the Service's operation;
use the Service in any way that violates applicable law.

8. User Content

Organizational accounts may post announcements, messages, or calendar events ("User Content"). You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to host, store, and display it as needed to operate the Service. You represent that your User Content does not violate any law or third-party right.

9. DMCA & Copyright Complaints

If you believe content on the Service infringes your copyright, send a written DMCA notice to support@pineapplestorytime.com including: (a) your signature; (b) identification of the copyrighted work; (c) the location of the allegedly infringing material; (d) your contact information; (e) a statement of good-faith belief; and (f) a statement under penalty of perjury that your notice is accurate.

10. Termination

You may terminate your account at any time from your settings. We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms, suspected fraud, non-payment, or as required by law. Upon termination, your license to use the Service ends immediately. Sections 6, 9, 11, 12, 13, and 14 survive termination.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Pineapple Storytime LLC and its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our total cumulative liability for any claim shall not exceed the greater of (a) the amounts you paid us in the twelve (12) months preceding the claim or (b) one hundred US dollars ($100).

13. Indemnification

You agree to indemnify and hold harmless Pineapple Storytime LLC and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your use of the Service, or your violation of any law or third-party right.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to personal jurisdiction there. You waive any right to a jury trial and to participate in a class action.

15. Changes to Terms

We may modify these Terms at any time. We will post the updated Terms on the Service and update the "Last Updated" date. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance.

16. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent. These Terms, together with our Privacy Policy, are the entire agreement between you and Pineapple Storytime LLC regarding the Service.
